CBD - Legal in the Philippines?

Another "know before you go" article. This one might keep some people out of prison!

In April of 2023, I published a video describing the use and legality of CBD use in the Philippines (linked thumbnail above). I recently received a comment on this video stating that Gummies were now legal, but to my understanding, the legality of CBD gummies is a complex issue due to the country's strict drug laws. You might find some ambiguous information online suggesting that CBD Gummie products under 0.3% THC content are legal, but I cannot ascertain this to be true. If one is to search online E-Commerce sites like Shopee and Lazada, you might find CBD Gummie products advertised for sale (which some claim to be fake). Personally, I would exercise caution.

My latest understanding is this: Under Republic Act 9165, the Comprehensive Dangerous Drugs Act of 2002 remains in force, which substantiates all forms of cannabis and its derivatives—including CBD (cannabidiol)—are classified as illegal unless specifically authorized for medical or scientific purposes. The Philippine Drug Enforcement Agency (PDEA) has consistently stated that any cannabis-derived products, including those containing CBD, are prohibited without proper approval.

Gummies... That's a Big No!

CBD gummies, which are typically marketed as food or dietary supplements infused with CBD, do not currently fall under any legal exemption for general sale or use in the Philippines. While the Food and Drug Administration (FDA) has allowed limited use of CBD in specific cases—such as the approval of Epidiolex, a CBD-based drug for epilepsy—such products require registration and are tightly regulated. Unregistered CBD products, including gummies, are considered illegal, and their possession, sale, or use can result in severe penalties, including imprisonment and fines.

There have been efforts to reform cannabis laws, such as the proposed Philippine Compassionate Medical Cannabis Act, which would allow medical marijuana under strict conditions. However, as of March 28, 2025, this legislation has not been fully enacted, and it does not explicitly address CBD gummies for non-medical use. Additionally, even if CBD contains no THC (the psychoactive compound in cannabis), the PDEA and FDA do not distinguish between THC-free CBD and other cannabis derivatives in their general prohibition.

Compassionate Special Permit (CSP)

For individuals with serious or terminal illnesses, a Compassionate Special Permit (CSP) can be applied for through the FDA to use unregistered drugs, including those containing CBD, but this is a case-by-case process and not applicable to over-the-counter products like gummies. I have heard of some people bringing products like CBD cream with them to the Philippines (unknowingly) and passed through Customs without issues. That doesn't mean you should try it! The way you want to begin your vacation or retirement in the Philippines is not in one of the country's prisons.

In summary, CBD gummies are NOT legal for general purchase, sale, or use in the Philippines as of now. Bringing them into the country or possessing them without proper authorization could lead to legal consequences. If you're considering CBD for a specific medical need, you would need to consult a healthcare professional and explore the CSP process through the FDA. Always stay updated on local laws, as the situation could evolve with future legislative changes.
